What is Employer Nominated Visa (Subclass 186)?

This visa is a permanent residence visa for skilled workers. It allows the visa applicant to work in Australia under one of the three streams:

Temporary residence transition stream:
This stream is for subclass 482 visa holders who have worked for their employer for at least two years and employer wants to offer them a permanent position in that same occupation.

Direct Entry Stream:

This stream is for persons who are untested in the Australian labour market and are applying for ENS either from inside or outside Australia, and are not eligible for temporary residence transition.

Labour Agreement Stream:

This stream is for the persons who are being sponsored by an employer through a tailored and negotiated labour agreement.

Have been nominated by an approved Australian employer within six months before visa applicant applies for the visa.
Be under the age of 45 at the time of application.
Have required skills and qualifications for the position (which includes required registration, licensing or professional membership necessary for nominated occupation).
Have appropriate English language skills.
Meet health and character requirements.
Meet requirements of the stream in which they apply.

ENS Temporary Residence Transition Stream Requirements:

To get visa under Temporary Residence transition stream you must:

hold a current temporary work (skilled) visa (Subclass 482).
Have worked for two years with their sponsoring employer through subclass 482 visa.
Have been nominated by the sponsoring employer for a permanent visa.
Must have vocational English.

No skills assessment is required because visa applicant being 482 visa holder, has already worked for the nominating employer for two years in Australia.
ENS Direct Entry Stream requirements:

To qualify under direct entry stream, you must:

Have been nominated for a position under this stream and that nomination has been approved.
Have at least three years of relevant work experience or Australian Qualification.
Have a positive skills assessment conducted by the relevant assessing authority if you have not studied in Australia.
Have at least competent English.

ENS labour agreement stream requirements:

To qualify under labour agreement stream, you must:

Have been sponsored by an employer through a labour agreement.
Have vocational English.

Outcome of Subclass 186 Visa:

Subclass 186 visa once granted, permits the visa holder to:

Stay indefinitely in Australia.
Work fulltime and study in Australia.
Enrol in Medicare (Australia’s scheme for health related care and expenses).
Travel to and from Australia for 5 years from the date the visa is granted.

What is Regional Sponsored Migration Scheme (RSMS) Visa (Subclass 187)?

This visa is a permanent residence visa for skilled workers who want to work in regional Australia (Regional Australia includes low population growth areas of Australia, it does not include Melbourne, Sydney, Brisbane, Gold Coast, Wollongong). This visa allows the visa applicant to work in Australia under one of three streams:

This visa allows employers to employ overseas workers when they are not able to source and employ the appropriately skilled Australian for the same job. This visa ensures that Australian workers get priority and in case they are not available, then employers are able to address the labour shortages by bringing genuinely skilled workers.

What is the time duration for a 482-visa?

The Temporary Skill Shortage (TSS) visa allows you to live and work in Australia on a temporary visa, for 1, 2, 3 or 4 years.

How many streams does the 482 visa have?

It has three streams:

Short-term stream
Medium-term stream
Regional stream.

What is the eligibility criteria for a 482 visa?

To be an eligible applicant for a 482 visa, you need to fulfill below:
- must have at least two years of full time and relevant work experience in the past five years
- have the qualifications and/or work experience to meet the Skill Level requirement of your occupation
- need to demonstrate your English ability, unless exempt
- obtain licencing or registration (if compulsory in your occupation)
- are not restricted by an age limit
- require police clearances
- can apply for a 482 visa as the holder of a Bridging Visa A, Bridging Visa B and Bridging Visa C (provided you have not had a visa refused whilst onshore on a bridging visa)

What is the eligibility criteria for an employer to sponsor an applicant for a 482 visa?

As a sponsor an employer needs to fulfill below criterion:
- hold Standard Business Sponsorship (SBS) approval (or be in the process of becoming an approved sponsor)
- nominate an occupation on one of the 482 visa shortage lists
- meet caveats that apply to visa applicant’s occupation. A caveat may refer to a minimum company turnover, a minimum number of employees or a specific salary
- meet the Labour Market Testing requirement, unless exempt
- pay the Skilling Australians Fund (SAF) Levy when nominating you (the amount is based on company turnover and the number of years a visa applicant will be nominated on the 482
- pay visa applicant at least $53,900 + super for a full time 38-hour week, unless a higher amount is specified as a caveat

482 occupation lists

Short-Term Skilled Occupation List (STSOL)

You can be nominated for one or two years
You can apply for a further one or two year visa whilst onshore
You may be able to lodge third 482 visa offshore
You need to show that you are a genuine temporary entrant (this depends on the length of time in Australia, visas held, visa refusals and your likelihood to return home to your country of origin in the future)
You need to score an overall 5.0 in the IELTS (or equivalent test), unless exempt
You pay a lower visa application charge than MLTSSL applicants
There is no pathway to permanent residency, unless you fit under the transitional / grandfathering arrangements

Medium and Long-Term Strategic Skills List (MLTSSL)

You can be nominated for 1, 2, 3, or 4 years
You can apply further 482 visas without limit
You need to score 5.0 in all parts of the IELTS (or equivalent test), unless exempt
You pay a higher visa application charge than STSOL applicants
You will be eligible for permanent residency when the following applies:
- You have worked for the same sponsor for three years on a 482 visa
- You have worked in the same occupation for the three years on the 482 visa
- You hold a score of at least 6.0 in all parts of the IELTS (or equivalent test), unless exempt
- You have been paid at least the salary on your nomination letter
- You are under 45 years of age at the time of lodging your PR visa

If you held a 457 visa prior to your 482 visa, you may be eligible for permanent residency transitional / grandfathering arrangements

Regional Occupation List (ROL)

The ROL has the same eligibility requirements as the MLTSSL, apart from the fact that the sponsor and the nominated position must be in a regional postcode.

What are the Regional Occupation List postcodes?

Regional Occupation List postcodes are subject to change and can be found on the Department of Home Affair’s website.

Does the 482 occupation list change?

The Department of Home Affairs makes changes to the shortage list based on industry and economic factors. However, a 482-visa occupation is ‘fixed on its list’ at the time of visa application. This means that your lodged 482 application will not be impacted if the occupation is removed from the list, during the processing time. It does mean that a future 482 visa may not be possible. Conversely, if you are nominated in an occupation on the STSOL and your job moves onto the MLTSSL, a permanent residency pathway may open up to you.
